Tenant Obligations (as referenced in this contract):
Clause 1: The tenant must check the condition of the rented car before taking charge of it. After receiving the car, they are solely responsible for it.
Clause 2: The tenant agrees to take good care of the rented car and use it without abuse. They remain responsible for any damage in accordance with Article 663 of the Obligations and Contracts Code.
Clause 3: In accordance with Article 674 of the Obligations and Contracts Code, the tenant must immediately and without delay inform Jasami Car of any circumstances requiring the company’s intervention, whether urgent repairs, unexpected defects, breakdowns, or damages caused by third parties. Failure to do so will result in the tenant bearing all expenses related to subsequent damage caused to the rented car.
Clause 4: The tenant agrees not to transfer or sub-rent the rented car to another person, nor use it in an unauthorized manner, in accordance with Article 669 of the Obligations and Contracts Code.
Clause 5: The tenant is not entitled to request financial compensation from Jasami Car in the event of delayed car delivery, contract cancellation, or repair duration, even if the damage occurs during the rental period.
Clause 6: The tenant must ensure not to leave the car documents, including the rental contract and keys, outside the vehicle.
Clause 7: The tenant declares having checked the five tires of the rented car and confirms they are in good and usable condition. In the event of tire damage, the tenant must immediately inform the company and replace it with a tire of the same type, size, and brand. The tenant also confirms having checked the signal lights and all required car equipment such as the warning triangle, safety vest, etc.
Clause 8: The tenant agrees not to tamper with the car’s odometer. Otherwise, they must compensate the company a minimum of 500 MAD per day.
Clause 9: The maximum allowed distance is 300 kilometers.
Clause 10: The tenant agrees to assume responsibility for all damages caused to upper equipment of utility vehicles and is therefore solely responsible.
Clause 11: The tenant agrees to run the engine for 10 minutes prior to departure after any stop exceeding 5 hours.
Vehicle Return:
Clause 1: The tenant agrees to return the vehicle during Jasami Car working hours, and therefore the car remains in their possession and responsibility until work hours begin.
Clause 2: The tenant is not allowed to hand over the car documents or keys to anyone other than Jasami Car staff or authorized employees. In case of loss of any document or keys, the tenant will bear all related replacement costs, as well as daily rental fees during the immobilization period of the vehicle.
Clause 3: The tenant must remove all personal belongings from the car before returning it to Jasami Car.
Clause 4: The tenant agrees to return the vehicle at the end of the rental period specified in the contract. Failing to do so may lead to legal prosecution under Articles 505-525-547 of the Moroccan Penal Code.
Clause 5: If an inspection or condition list is included in the rental contract, the tenant must return the car in the same condition as received, in accordance with Article 676 of the Penal Code.
Clause 6: It is strictly forbidden for the tenant to abandon the rented car for any reason.
Rental Company Obligations (Jasami Car):
Clause 1: Jasami Car agrees to deliver the rented car in good condition and ready for use.
Clause 2: The company must provide the tenant with all vehicle documents, ensuring none are expired prior to delivery.
Clause 3: Jasami Car cannot request compensation for engine damage caused by mechanical failure due to normal use without negligence from the tenant. If responsibility cannot be determined, an expert assessment will be requested.
Clause 4: In accordance with Article 683 of the Moroccan Penal Code, if Jasami Car authorizes minor repairs by the tenant, the company must reimburse the cost based on invoices or equivalent proof.
Rental Amount:
Clause 1: The rental amount must be paid in advance and clearly stated in the contract.
Clause 2: Payment must be made immediately after drafting the contract and before delivery of the vehicle.
Payment Methods:
Clause 1: The rental fee may be paid using legally accepted payment methods (cash, bank check, or credit card).
Security Deposit:
Clause 1: The tenant must provide a predetermined deposit (franchise) through approved payment methods, as specified in the insurance contract.
Clause 2: If Jasami Car receives the deposit, it must be documented in writing in the rental contract.
Clause 3: Jasami Car commits to refund the deposit if the vehicle is returned in the same condition as received.
Extension of Rental Agreement:
Clause 1: The tenant must inform Jasami Car in writing at least 24 hours before the rental period ends to request an extension.
Clause 2: Jasami Car reserves the right to accept or refuse an extension. If refused and the vehicle is not returned on time, the company may recover the vehicle and take legal action.
Additional Driver:
Clause 1: If the tenant wishes to add an additional driver, they must provide a valid driving license of at least six months. Only one additional driver is permitted and assumes the same responsibilities as the primary driver.
Minimum Rental Period:
Clause 1: The minimum rental duration is 48 hours, and exceeding by one hour counts as an additional rental day.
Vehicle Maintenance & Monitoring:
Clause 1: The tenant must check water, oil, and tire pressure daily. Oil change outside Marrakech is allowed only with company approval by phone or email (invoice required).
Fuel & Vehicle Cleanliness:
Clause 1: Fuel costs are borne by the tenant. The car must be returned with the same fuel level, otherwise 100 MAD per missing level will be charged.
Clause 2: The car must be returned clean; otherwise a cleaning fee of 100 MAD applies.
Comprehensive Insurance – Third Party:
Technical Damage (Technical Regulation)
Clause 1: The tenant must pay a deductible based on a percentage of the car’s value set by the insurer.
Clause 2: Damage evaluation is performed by a specialized expert.
Clause 3: Jasami Car may request compensation for total loss of use of the vehicle in accordance with Article 264 of the Road Code.
Economic Damage (Economic Regulation)
Clause 1: The tenant must pay a deductible.
Clause 2: Damage assessment will be carried out by an expert.
Clause 3: Immobilization of the vehicle will be charged at 70% of the daily rental rate, plus towing fees.
Civil Liability Insurance:
Clause 1: The tenant is responsible for all repair costs, immobilization period, total or partial loss of use, towing and transportation expenses if the rented car sustains damage.
Accidents:
Clause 1: In case of an accident, the tenant must notify the company immediately (phone/email/writing) before taking further action. A police report must be provided. If not possible, the tenant must declare in good faith that no injuries or reports occurred.
Clause 2: In case of an amicable report, the tenant must inform the company and provide a copy within 48 hours.
The Tenant is Not Allowed to Drive in the Following Cases:

Driving under the influence of alcohol or drugs

Driving on unpaved roads

Illegal passenger transport

Transport of flammable or explosive materials

Racing or driving lessons

Towing/pushing vehicles or carts

Engaging in illegal activities
If any of the above is violated, Jasami Car may retrieve the car without restriction.
Tenant Arrest & Vehicle Seizure:
If the tenant is arrested for illegal acts and the car is seized, they bear all responsibility and must notify the company immediately.
Theft / Fire:
The contract is suspended once the tenant immediately reports the theft/fire to Jasami Car. The police report and vehicle documents/keys must be provided within 48 hours.
Traffic Violations:
Clause 1: The tenant is legally responsible for all fines and must inform the company within 48 hours.
Clause 2: For radar violations, Jasami Car will provide contract copies to authorities. If the car registration is confiscated, the tenant must pay daily rental fees for the entire retention period and all related expenses.
Territorial Authorization:
Clause 1: The rented vehicle may not leave Morocco without written authorization from Jasami Car and relevant authorities (if required).
Mutual Contract Commitment:
Clause 1: Both parties agree to respect and apply all rental conditions outlined in this contract.
Arbitration & Court Jurisdiction:
Clause 1: Any dispute between the tenant and Jasami Car will be resolved through arbitration or court. Only courts of Marrakech have jurisdiction.
